  • Surcharging—adding a fee for credit card payments—is prohibited by Visa in most cases, even in places where laws might technically allow it.

2. Dual Pricing Is Legal But Regulated

  • Dual pricing (cash vs. card prices) is legal throughout the U.S., but must follow strict rules.
  • You must clearly display both prices. The default (larger or more prominent) price should be the credit card price, and the discounted cash price must also be visible.
  • Visa enforces compliance: failing to comply—e.g., not properly displaying dual prices or presenting the discount as a surcharge—can result in penalties (possibly starting around $5,000).
